Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Landy, a shared property maintenance and compliance logbook operated from New Zealand. By creating an account or using Landy, you agree to these Terms in full.

1. The service
Landy is a web application that allows landlords to track property maintenance, Healthy Homes compliance, and inspection records, and that allows tenants to report maintenance issues and receive updates — all in a shared, property-bound logbook.
Landy is not a property management platform, real estate agency, letting service, legal service, or financial advisor. We do not act as an agent for either landlords or tenants.
2. Accounts
- You must be 18 or older to create an account.
- You must provide accurate information when you sign up.
- You are responsible for keeping your password secure and for all activity under your account.
- Notify us immediately at hello@landylogbook.com if you suspect unauthorised access.
- One person, one account. Do not share accounts.
3. Test period
Landy is currently in a free test phase. During the test:
- No payment is required.
- You may add unlimited properties.
- We may adjust, limit, or expand features at any time without notice.
- We may end the test and transition to paid plans. We will give you at least 30 days’ notice before any paid transition takes effect.
4. Landlord responsibilities
If you use Landy as a landlord, you agree that:
- You own the properties you add, or you are authorised to manage them.
- You will not add properties for which you have no legal right to collect or store personal information about tenants.
- You will use the invite system to connect only genuine tenants of the listed property.
- You are responsible for ensuring your use of the platform complies with your obligations under the Residential Tenancies Act (NZ) or equivalent Australian state legislation.
- You will not use Landy to harass, discriminate against, or disadvantage any tenant.
5. Tenant responsibilities
If you use Landy as a tenant, you agree that:
- You will only join properties that are your genuine current place of residence.
- You will submit maintenance reports honestly and in good faith.
- Photos you upload are of your actual rental property and do not infringe any third-party copyright or privacy rights.
6. Acceptable use
You must not:
- Use Landy for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorised access to any part of the service, other users’ data, or Landy’s infrastructure.
- Upload content that is unlawful, harmful, threatening, defamatory, obscene, or infringes any intellectual property rights.
- Use automated means to scrape, copy, or index any content from Landy.
- Interfere with or disrupt the service or its infrastructure.
- Attempt to reverse-engineer the software.
7. Your content
You retain ownership of any content you upload to Landy (maintenance reports, photos, property details). By uploading content you grant us a non-exclusive, royalty-free licence to store and display that content for the purpose of delivering the service to you and your co-users (landlord or tenant of the same property).
We do not use your content to train AI models or share it with third parties for marketing.
8. Shared logbook nature
Landy is explicitly designed so that landlords and tenants of the same property share a common view of maintenance history, inspection records, and Healthy Homes compliance. By joining a property (as a tenant) or inviting a tenant (as a landlord), you acknowledge and consent to this shared visibility.
9. Intellectual property
The Landy application, brand, and underlying technology are owned by us. Nothing in these Terms grants you any right to use the Landy name, logo, or trademarks without our prior written consent.
10. Disclaimers
Landy is provided “as is” without warranty of any kind, express or implied. We do not warrant that:
- The service will be uninterrupted or error-free.
- Any information on the service constitutes legal advice about tenancy obligations, Healthy Homes requirements, or any other matter.
- The service is suitable for any particular purpose.
Landy is a record-keeping tool. Compliance with the Healthy Homes Standards or Residential Tenancies Act remains solely your responsibility. Always consult a qualified professional for legal or compliance advice.
11. Limitation of liability
To the maximum extent permitted by law, Landy is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the service.
Our total liability to you for any claim arising under these Terms is limited to the amount you have paid us in the 12 months preceding the claim, or NZD $100 if no amounts have been paid.
12. Privacy
Your use of Landy is subject to our Privacy Policy, which is incorporated into these Terms by reference.
13. Termination
You may delete your account at any time by contacting hello@landylogbook.com.
We may suspend or terminate your account if you materially breach these Terms, or if we are required to do so by law. We will give you notice where reasonably practicable.
14. Changes to these Terms
We may update these Terms. We will notify you by email or prominent in-app notice at least 14 days before material changes take effect. Continued use of Landy after that date constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts, unless you are an Australian consumer in which case Australian Consumer Law may apply and you retain any non-excludable rights available to you under that law.
